While a Project Manager acts as an agent focused on protecting the Employer’s overall commercial and operational goals, the FIDIC Engineer holds a specific, legally defined role under the contract. When making Determinations regarding time, cost, or quality between Employer and Contractor, the Engineer must act professionally, objectively and impartially (or neutrally, depending on the FIDIC edition), preventing unnecessary dispute escalation.
The choice depends on design responsibility and risk allocation strategy: Red Book (Building and Engineering Works Designed by the Employer): Best when the design is fully detailed by the Employer’s design team before construction. Yellow Book (Plant and Design-Build): Ideal when the Contractor carries design responsibility based on defined Employer’s Requirements. Silver Book (EPC/Turnkey): Used when high certainty of final price and completion date is paramount, transferring design and execution risks predominantly to the Contractor. We advise on the optimal form during the early procurement strategy phase.
Disputes usually arise from delayed decisions, poor contemporaneous records or unaddressed claims. As Engineer, we enforce strict adherence to contractual notice periods, maintain real-time logs of potential events and issue fair, fully reasoned Determinations promptly. By resolving cost and time impacts as they occur on site rather than deferring them, we keep projects out of DAB/DAAB proceedings or arbitration.
